By Chief Steven J. Wojnar Dudley Police Department I was asked a question about the use of headphones while operating a motor vehicle. What if someone is using “ear bud” style headphones while driving? The availability of Blue Tooth service in many vehicles (which allows music or pod casts from your phone to be broadcast over the car speakers) has reduced the number of times drivers may use headphones. However, many people may still use these devices. I was asked to provide some information on any laws relative to using headphones while driving? In Massachusetts, it is illegal to operate a motor vehicle while using headphones. Massachusetts General Laws Chapter 90 Section 13 is more commonly known as the “impeded operation” statute. A portion of this law makes it is illegal to wear headphones while operating unless their use is necessary for communication to control the movements of the vehicle. Since this would only be necessary at times of construction, or in other limited circumstances, the “need” to use headphones while driving is very unlikely. A violation of this section carries a $35 civil fine. If there is a pressing need to listen to certain music or other media while driving, all necessary precautions should be taken to insure this is done “hands free.” Use the car speakers whenever possible. If your vehicle does not have this capability, there are several relatively inexpensive speaker options available to use for this purpose. Headphone use limits a driver’s ability to hear what is happening around them at a given time. |
