By Chief Steven J. Wojnar Dudley Police Department Advances in technology can bring about new questions. Cell phones and other electronic devices are used more than ever today. There are also a variety of ways to listen to music as well as talk hands-free with a phone. I was asked if it was against the law to use headphones or similar devices while driving a car. The short answer is these electronics may be used in your vehicle. However, in most instances, it is illegal to listen with headphones, ear buds, etc. while driving. Massachusetts General Laws Chapter 90 Section 13 is the section of the law which addresses issues of “impeded operation.” The last line of this section states, “No person shall operate a motor vehicle while wearing headphones, unless said headphones are used for communication in connection with controlling the course or movement of said vehicle.” Since things like listening to music does not in any way provide a direct connection to the operation of a vehicle, the use of headphones of any kind, would not be allowed. The penalty for a violation of this section is a $35 civil fine. There are solutions to this problem. Most devices can be connected to play the music, answer the phone, etc. through the vehicle radio. Newer vehicles are generally equipped with “Blue tooth” or other connection capability to allow the sound to be projected over the car speakers. Those vehicles without this capability can find equipment which can be installed to accomplish this goal. Anyone who is interested in this can check on-line, with your vehicle dealership, or at most electronics stores. Don’t take the chance of further distraction simply because you wish to listen to your favorite music. Using earphones while driving can limit your ability to make observations of your surroundings. This can cause an accident or injury in many instances. If you wish to listen to something while in the vehicle, please take the time to use the devices properly. |
