By Chief Steven J. Wojnar Dudley Police Department Warmer weather results in a variety of outdoor activities. Many people who have been issued firearms licenses are seeking opportunities to target shoot. I was recently asked to provide any restrictions people should be aware of when doing this type of activity. Main thing people should know is to shoot in places where you are lawfully able to do so. People should shoot away from homes or areas where people may be found and there must be a sufficient “backstop,” such as a mound or a hill, where bullets may lodge safely. People wonder how far away they must be from homes or people to do this safely. Massachusetts General Laws Chapter 269 Section 12E is the law pertaining to the discharge of a firearm within 500 feet of "a dwelling or other building in use." There are several exceptions present in this statute. One of these allows for shooting within this distance "with the consent of the owner or legal occupant thereof…" A person would therefore be allowed to shoot in their own yard and not be in violation. This law is in place to provide a minimum distance away from people. There is always the possibility of a “stray” bullet either through accidental discharge or a ricochet. This is the reason to ensure you are as far away from people as possible. One important point to take under consideration is the presence of neighboring homes or buildings. If these places would be within 500 feet of where the shooting is taking place, a person would need consent of those property owners to do so. Without this, a violation would be in order. Penalties can include a fine of up to $150 and/or a jail term of up to three months. |
The discharge of firearms must always be taken seriously with the appropriate precautions. Bullets cannot be recalled in the event of a mistake. Know your surroundings, exercise the appropriate care, and always be cognizant of the possibility of a ricochet.
