Dudley Police Department I received a question regarding the proper procedures to follow at a stop sign. The person raising this issue was concerned about drivers failing to stop at the proper location when at these intersections. In particular, they were concerned with vehicles that either do not make a complete stop or do so too far into the intersection. If a car is in the wrong position, it can force others traveling in the area to take evasive measures. I was asked to provide some information to people on proper stopping procedures. Massachusetts General Laws Chapter 89 Section 9 addressees the proper driver expectations while at an intersection with a stop sign. It reads in part, "Every driver of a vehicle approaching a stop sign or a flashing red signal indication shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection, or, if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering it." According to the law, the stop line is the primary location to stop at one of these intersections. If there is no line or crosswalk, the driver must stop in an area with a clear view of traffic before proceeding into the intersection. It is the obligation of the driver with the stop sign to yield the right of way to the other traffic in the intersection. For this reason, it is important to stay within your travel lane and not impede the path of other drivers. It is also important to remember these rules apply to each vehicle in line at a stop sign. If a car is second or third in line and stops behind others, the driver still has the obligation to stop when it reaches the stop line or other proper area. Particular attention must be paid in thickly settled areas where the streets may be narrow or lack markings. The penalty for a stop sign violation is a fifty-dollar civil fine. |
Intersections with stop signs are areas where accidents may occur if drivers do not exercise the proper precautions. Most stop lines are usually in a predetermined place where stopping vehicles should have a clear view of the other traffic before proceeding. Remember to always stop in the appropriate location and maintain an awareness of both vehicle and pedestrian traffic.
